Multiple Prime Delay Claim Denied Coordination; Multiple Prime Contracts

A federal appeals court has denied a contractor's delay claim against the surety of a defaulted separate prime contractor.

The Arkansas State Highway Commission awarded a contract to Potashnick Construction, Inc. to perform the grading and structural work on a section of highway. The Commission also awarded a contract to Angelo Iafrate Construction LLC to perform the surfacing work on the same section of highway. Both contracts incorporated the standard state highway specifications.
