Cm May Be Liable For Schedule Misrepresentation Multiple Prime Contracts; Schedule

The Kentucky Supreme Court has ruled that a trade contractor with no direct agreement with a construction manager (CM) could sue the CM for alleged negligent misrepresentation of the schedule.

DeLor Design Group, Inc., owner of a commercial building, awarded a contract to Presnell Construction Managers, Inc. to serve as the CM in the renovation of the property. DeLor subsequently awarded a contract to EH Construction, LLC for general trade work.
