Proposed Schedule Affected "Low"Bid Bids-solicitations; Schedule

A federal court has ruled that a project owner reserved the right to consider proposed completion times when determining the "lowest qualified bidder."

Milton-Freewater Orchard Homes, Inc. (Orchard Homes) solicited bids for construction of a 140-unit, lowincome family housing project in Milton-Freewater, Oregon. Orchard Homes is a not-for-profit corporation. The project was financed by the federal Rural Housing Services. The bidding was therefore subject to the federal regulations found at 7 C.F.R. sec. 1924.
