"Float Time"Clause Ruled Ambiguous Schedule; Delay; Disclaimers

A Washington court has ruled that while a contract said the project owner owned the "float time"in the contractor's schedule, the contract failed to adequately define that term.

The Orting School District No. 344 awarded a contract to Construction Enterprises & Contractors, Inc. (CE&C) to build an elementary school. The contract included the following provision.

"Float Time: The inclusion of float time in the activity listing of the Contractor's construction schedule shall be owned entirely by the Owner. The Contractor shall not be entitled to any adjustment in the contract time, the [...]
