Bid Responsive Despite Misdelivery Bids-responsiveness

An Oregon court has ruled that a bid was responsive even though it was hand-carried to the wrong municipal building. The designated recipient took possession of the bid and transported it to the proper location prior to bid opening.

The City of Bend issued an invitation for bids for a street improvement project. The solicitation stated that sealed bids would be accepted by the purchasing manager at the Public Works Building until 11:00 a.m. on March 9, 2001. The solicitation also said the City could reject any bid that did not comply with all prescribed procedures and requirements.
