Workers Sue Project Owner For Davis-bacon Omission Negligence

The Montana Supreme Court has ruled that construction workers could sue a public project owner in state court for failing to incorporate Davis-Bacon Act wage requirements into a construction contract.

The Wolf Point School District awarded a contract to Braden-Pehlke Construction Co. to build an addition to a high school building on the Fort Peck Indian Reservation. The project involved federal funds and the funding agreement required the School District to impose the requirements of the federal Davis-Bacon Act (DBA). The District neglected, however, to incorporate the wage requirements into the construction contract.
