Minority Contracting Program Struck Down Bids-solicitations

A federal court has ruled that a Florida program establishing goals for minority participation in state contracts violated the Equal Protection Clause of the U.S. Constitution.

The Florida legislature created a "remedial program" to ensure minority participation in state contracts, including construction contracts. An Office of Supplier Diversity (OSD) was created to assess whether state agencies were making good faith efforts to award contracts to minority business enterprises.
