Excusable Neglect Justified Withdrawal Of Mistaken Bid Bids-mistakes; Bonds-bid

A Wisconsin court has ruled that a bidder's mistake did not involve misjudgment or a lapse in procedure. This was excusable neglect and the bidder was entitled to withdraw its bid without forfeiture of its bid security.

The Wisconsin Department of Transportation solicited bids for construction of a highway interchange in Milwaukee. James Cape & Company was preparing a bid on the contract.
