Alternate Items Affect Bidder Qualification Bids-responsibility

In another case involving alternate bid items, a New Jersey court has ruled that a bidder's qualification to perform public work is based only on the actual scope of work selected by the project owner.

The Jackson Township Board of Education issued an invitation for bids for construction of a new high school building. The bid schedule consisted of a base bid and 52 alternate items. The Board reserved discretion to evaluate the bids and award the contract based upon the base bid and any combination of alternates it selected.
