Clarification Duty Existed On Design-build Contract Plans And Specifications; Changes-constructive

The Department of Veterans Affairs Board of Contract Appeals has ruled that even on a design-build contract, a contractor has a duty to seek pre-bid clarification of patent ambiguities in the design parameters.

The VA awarded a fixed-price contract to United Excel Corp. to furnish final design and construction services for a post anesthesia care unit at a medical center in Kansas City, Missouri. The contract included design parameters with which the contractor was required to comply.
