Contractor Not Responsible For Design Problems Architects And Engineers; Indemnification

The Alabama Supreme Court has ruled that a contractor could not be held responsible for problems caused by a defective design. The contractor was entitled to indemnification from the architect for liability to the project owner.

Stonebrook Development, LLC awarded a contract to Matthews Brothers Construction Co., Inc. for construction of roadways and other improvements in a new residential subdivision. The contract incorporated drawings and specifications prepared by Sanford, Bell & Associates, Inc. (SBA).
