Nevada High Court Enforces "No Lien" Clause Liens; Waiver

The Nevada Supreme Court has enforced a "no lien" provision in a construction contract, prospectively waiving all the contractor's statutory mechanic's lien rights.

Parkway Manor, Inc. awarded a contract to Dayside, Inc. to construct an apartment building. Under the terms of the agreement, Dayside agreed that it would not file a mechanic's lien or otherwise assert any claim against Parkway's real estate "on account of any work done, labor performed or materials furnished under this contract...to the extent such waiver is in accordance with Nevada law."
