Statutory Notice Requirements Prevail Bonds-payment; Notice

The New Hampshire Supreme Court has ruled that a payment bond did not waive the notice provisions of a public works payment bond statute. And strict compliance with the statute was required.

The Pease Development Authority, a political subdivision of the State of New Hampshire, awarded a contract to Abatement International/Advatex Associates, Inc. (Advatex) for asbestos abatement and building demolition at the Pease International Tradeport in Newington. Advatex furnished a payment bond issued by American Guarantee and Liability Insurance Co.
