"Clerical Mistake"Included Misinterpretation Bids-mistakes; Bonds-bid

The Idaho Supreme Court has ruled that a "clerical mistake"in a bid included the misinterpretation of a phrase used by a subcontractor in its quotation. The bidder could withdraw its bid without forfeiture of the bid bond.

The Idaho Transportation Department solicited bids for a highway construction project in Bonner County. Westway Construction, Inc. was preparing to bid on the contract. Westway obtained price quotations from two asphalt subcontractors and incorporated the lower price, from Acme Materials and Construction Co., into its bid.
