Labor Supplier Not Protected By Bond Or Retainage Bonds-payment; Retainage

A Washington court has ruled that a labor leasing company, or "professional employer organization"(PEO), was not protected by a payment bond or retainage held under a public works lien statute.
The Metropolitan Parks District of Tacoma awarded a contract to Caicos Corporation for restoration of a park. Caicos furnished payment and performance bonds issued by The Insurance Company of the West. Caicos then subcontracted the concrete work to MK Construction, Inc.
