Waiver Enforced In Aia Cm Agreement Insurance; Waiver

A Connecticut court has enforced the reciprocal waiver of insured loss provision in the AIA construction management contract documents. And the waiver protected a design consultant that had not yet signed an agreement with the construction manager.

Best Friends Pet Care, Inc., owner of a chain of pet care facilities, was developing a new property in Rocky Hill. Best Friends retained Highland Management Associates, Inc. to serve as construction manager (CM). The parties signed the American Institute of Architects Document B801/CMa, "Standard Form of Agreement Between Owner and Construction Manager," 1992 edition.
