Construction Manager Functioned As General Contractor Bonds-payment; Suppliers

The Rhode Island Supreme Court has allowed a supplier to proceed against a payment bond even though the prime contract called for "construction management services" and required trade contractors to provide their own bonds.

The Warwick School Committee awarded a contract to Berkshire Construction Services, Inc. for construction management services on a school building project.
