Takeover Surety Had No Recourse With Board Termination-default; Bonds-performance

The Armed Services Board of Contract Appeals has ruled that a surety for a defaulted contractor could not file a claim under the Contract Disputes Act for an improper payment to the contractor made prior to a takeover agreement. And the takeover surety could not recover for government delay because no new schedule had been established.
