Owner Waived Change Order And Notice Requirements Changes-directed; Waiver

A Missouri court has ruled that a project owner lost the right to enforce requirements for written change orders and notice of cost overrun when the owner repeatedly issued oral directives for additional work.

DLJ Properties, Inc. awarded a contract to Staat Construction Co. to build an office complex in Jefferson County. Under the terms of the cost-plus contract, Staat guaranteed a maximum price of $1,600,252. The drawings and specifications included an attachment with a series of cost estimates for the various elements of the project.
