Bid Rejected Due To Undisclosed Scheduling Requirement Bids; Schedule

The Kansas Supreme Court has ruled that a public project owner improperly rejected a low bid based upon scheduling requirements not disclosed in the bid solicitation.

The City of Deerfield issued an invitation for bids for a street improvement project. The solicitation instructed bidders to submit a commencement date no later than October 17, 2000. Project completion was required within 75 days of commencement of the work. The contract was to be awarded to "the lowest responsible, responsive bidder."

Ritchie Paving, Inc. submitted the low bid. Ritchie specified a commencement date of October 1, 2000. The C [...]
