Nonresponsibility Determination Upheld Bids-responsibility

An Ohio court has ruled that when evaluating a low bidder's responsibility, a public project owner was not required to weigh four successful projects against one troubled project.

The Tri-Village Local School District solicited bids for the general trades package for renovation and expansion of a school building. Monarch Construction Co. submitted the low bid. The District's construction manager, Turner Construction, investigated Monarch's responsibility. Of five projects performed by Monarch, one had not gone well.
