Utility Obligated To Mark Buried Lines For Contractor Negligence; Delay-damages

An Illinois court has ruled that a telephone company had a statutory duty, but no common law duty, to mark underground utilities in order to avoid delaying a highway contractor.

The Illinois Department of Transportation awarded a contract to Plote, Inc. to make improvements to a highway in Arlington Heights. The DOT asked Illinois Bell Telephone Company, on several occasions, to indicate on the construction drawings the location of underground telephone lines.
