Settlement Offer Retracted Prior To Tender Of Payment Claims Administration

A California court has ruled that an exchange between a material supplier and a contractor did not create a binding settlement agreement. The supplier retracted its offer to settle prior to receiving payment.

Gledson/Cashman Construction, Inc. was the prime contractor on a school construction project in Carpinteria. Gledson obtained materials for the project from Sully- Miller Contracting Co. A dispute developed regarding payment for those materials.
