Settlement Offset Against Delay Damages Delay-damages

A North Carolina court has ruled that while a project owner was liable to a contractor for delay and disruption damages, the owner was entitled to an offset for the amount the contractor had recovered from the project architect for the same problems.

The North Carolina Department of Administration awarded a contract to RPR & Associates, Inc. The contract was awarded on behalf of the University of North Carolina - Chapel Hill for construction of a new campus alumni center. The project architect was O'Brien/Atkins Associates, P.A.
